Designs are Temporarily Gone

Since many of you copy, trace, and steal you work from other places I have decided to take your work down until I can figure out who has been breaking the law and who has not.

Sorry for the inconvenience, hopefully the designs will be back up within a week or two.

Please go to this thread if you are designer and want your work back up on the site, now. You can also read part of the thread below:

What is infringement and what is “inspiration”

Inspiration – What it is and how we use it

1. an inspiring or animating action or influence [you witness something that inspires you to make or do something]
2. something inspired, as an idea. [you have a random idea to make something or do something]
3. a result of inspired activity [you participate in a activity that inspires you to make or do something]
4. a thing or person that inspires. [you get inspired by a person, animal, plant, object, etc - or most commonly another piece of art or photo]

When it comes to making art, I think it would be safe to say that most inspiration comes from other art, photos, or ideas.

Just so you know – To be inspired by art, it does NOT mean you copy the design perfectly. If your design piece looks just like whatever you are copying, it’s not inspiration, it’s copying… The MissBimbo editing community has taught us all that it is ok to copy something directly and that it is ok to just call it “inspiration”. Well it is not “inspiration”.

Inspiration is when you take an idea or ideas and use them to come up with your own piece of art.

When it comes to all the designs that are at Nines now, most of them are just replica drawings of real life clothes. I repeat, this is not what the definition of inspiration is, as much as MissBimbo tells us. So, the term I would use for these designs are: Replica, Reproduction, or Imitation

These reproductions of fashion you will find at Nines are usually not infringing on any copyrights – however they are still not original pieces of art. The same goes for others who are now submitting designs to Nines, and all the MissBimbo clothing designs that are on BimboBin. Many of them are small digital replicas of real fashion design, but it does not necessarily mean that they are breaking any laws by existing.

Design is not inspiration if is just like the original design down to the last detail. So please everyone, I ask you to stop using the term ‘inspiration’ for these copies of art and start calling them “replicas”, “reproductions”, or “imitations”. It will make everything a whole lot clearer to understand if we start using the proper terminology. Thank you!

Infringement – What it is and how to avoid it

“Infringement of a copyright involves the copying of a material and substantial portion of the protected work. If the alleged infringer denies copying, the copyright holder may be able to prove infringement with circumstantial evidence of the infringer’s access to the protected work and of similarities between the two works.”

To avoid copyright infringement:
1. Do not trace others work and call it your own and display it publicly. Tracing privately for practice is perfectly fine.
2. If you must trace, trace only parts of other works. Very small parts. So small that it is so insignificant that no infringement is committed.
3. Don’t take images from the internet and paste your username on them, claiming you made them.
4. It’s fine to be inspired by others artwork, but if your final piece of art looks too similar in colors, shapes, elements, texture, pattern, etc it could very well be considered infringement. So be careful, take your time and make something original.
